Terms of Use

Effective date: July 17, 2026

These Terms of Use ("Terms") govern your access to and use of https://waxmancollision.com and its contact and photo-estimate features. The website is operated by WAXMAN OF TRI-STATE ("Waxman," "we," "us," or "our"). By using the website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website.

About this website

The website provides general information about auto body, collision, paint, protection, mechanical, towing-coordination, rental-assistance, and insurance-claim support services. Website content is informational and may be changed without notice. Availability, timing, pricing, parts, warranties, certifications, and repair requirements must be confirmed directly with the shop.

Photo estimates are preliminary

A photo estimate is an initial assessment based only on the information and images available at the time. It is not a final repair price, guarantee, insurance determination, or binding offer. Hidden damage, diagnostic results, calibration requirements, parts availability, labor operations, paint procedures, taxes, storage, towing, insurer requirements, and other conditions may change the scope or price after an in-person inspection or teardown.

No repair work is authorized merely because you submit a form or receive a response through the website. Any repair, payment, warranty, storage, towing, rental, or other service is governed by the separate estimate, authorization, repair order, invoice, or agreement you accept with the shop.

Insurance information

We may help document damage, communicate with an insurer, and prepare or negotiate a supplement. We are not your insurer, insurance agent, attorney, or public adjuster, and we do not control coverage, liability, claim approval, deductibles, rental benefits, payment timing, or an insurer's decisions. You remain responsible for reviewing your policy and communicating with your insurer when required.

Your submissions

You are responsible for ensuring that information you submit is accurate and that you have the right to provide it. Do not upload photographs or information that are unlawful, misleading, confidential to another person, or unrelated to a legitimate service request. In particular, submit vehicle photographs only when you own the vehicle or are authorized by its owner.

You keep ownership of your submissions. You give us permission to receive, store, copy, review, and share them only as reasonably necessary to respond to your request, assess damage, coordinate a repair or claim, maintain records, secure the service, and comply with law. Our handling of personal information is described in the Privacy Policy.

Telephone, text, and email communications

By providing contact information, you ask us to respond about your inquiry. If you choose text as your preferred method, you authorize service-related text messages at the number provided. Message and data rates may apply. You may ask us to stop texting at any time. Delivery of a message is not guaranteed, and urgent towing or safety needs should be handled by calling the shop or emergency services as appropriate.

Acceptable use

You may use the website only for lawful personal or business purposes connected with evaluating or requesting our services. You may not:

  • Interfere with the website, bypass security controls, probe for vulnerabilities, or introduce malicious code.
  • Use automated means to scrape, overload, copy, or access the website except as permitted by law or a written agreement.
  • Impersonate another person, submit fraudulent requests, or misuse another person's vehicle, insurance, or contact information.
  • Use website content or our name, marks, photographs, or designs in a misleading or infringing manner.

We may restrict or terminate access when we reasonably believe these Terms, the law, or the security of the website has been violated.

Intellectual property

The website and its original text, graphics, logos, design, code, photographs, and other materials are owned by or licensed to WAXMAN OF TRI-STATE and are protected by applicable intellectual-property laws. You may view and print a reasonable copy for personal, non-commercial use. No other license is granted unless we agree in writing.

Third-party services and links

The website may link to or embed maps, social networks, booking tools, insurers, manufacturers, or other third-party services. We do not control those services and are not responsible for their content, availability, security, terms, or privacy practices. Your use of them is governed by their own agreements.

Disclaimers

To the maximum extent permitted by law, the website is provided "as is" and "as available." We do not warrant that website content is complete, current, error-free, or suitable for a specific repair decision, or that the website will always be available or free from harmful components. Nothing on the website replaces a physical vehicle inspection, manufacturer repair procedure, professional diagnosis, signed repair authorization, or applicable legal or insurance advice.

Limitation of liability

To the maximum extent permitted by law, WAXMAN OF TRI-STATE and its owners, employees, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the website. Any liability that cannot lawfully be excluded will be limited to the greatest extent permitted by applicable law. These limitations do not alter rights that cannot be waived under consumer-protection or other applicable law.

Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Before filing a claim concerning the website, you agree to contact us and attempt to resolve the issue informally. Any proceeding that is not resolved informally must be brought in a court with jurisdiction in New Jersey, unless applicable law gives you another non-waivable right.

Severability and waiver

If a provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.

Changes to these Terms

We may revise these Terms as the website, services, or legal requirements change. Updated Terms become effective when posted here, and the effective date at the top will be updated. Continued use after an update means you accept the revised Terms.
